Privacy Policy
"Privacy Policy" is an integral part of the user agreement (hereinafter - Agreement) of the service "SMETTER" (hereinafter - Service), as well as a document defining the order of processing, systematization and disclosure of information provided by Users of the Service to the Rightholder (LLC "SMTR"), including personal information of Users, as well as information about the implemented requirements for the protection of their personal information.
1.1. Due to the fact that the "Privacy Policy" is an integral part of the Agreement, the terms and definitions disclosed in the Agreement are also applicable under the "Privacy Policy".
1.2. By registering on the Service, the User gives the Rightholder his/her unconditional consent to the processing of his/her personal information, both uploaded by the User and received by the Rightholder in the course of fulfillment of his/her obligations under the Agreement.
1.3. Personal information means the information uploaded by the User when going through the registration procedure and working in the Service.
1.4. In order to register on the Service, the User only needs to enter his e-mail address, his name (or pseudonym) and, if desired, a photo (or image) of the User, after which the confirmation of the creation of a personal account of the User (personal page of the User on the Service, through which he manages the services of the Service) is sent to the e-mail address specified by the User, and the services of the Service become available in accordance with the terms of the Agreement.
1.5. To authorize on the Service, the User must also compose and register on the Service a password to log in to their account.
1.6. For any appeals to the administration of the Service regarding the processing of personal information, the User should use the e-mail address specified during registration, which is also used as the User's login for authorization on the Service.
1.7. Each User has a personal account on the Service, through which he/she can add estimates and projects, record information on the execution of estimates and receive summary analytical information on them.
1.8. In order to confirm the data specified by the Users, the Rightholder has the right to request any supporting documents. In case of refusal to provide such documents, the Licensor has the right to block and/or delete the User's account and/or refuse to register on the Service.
1.9. Any personal information uploaded by the User on the pages of the Service is taken by the Rightholder "as is" and is not subject to prior verification for accuracy.
The User personally bears the burden of responsibility for the accuracy of the information provided on the Service.
1.10. The Rights Holder has the right to change (correct) the information disclosed or previously provided by the User on the Service, if it has reason to believe that such information is unreliable.
1.11. When disclosing or providing information, the Rightholder complies with the confidentiality requirements set forth in Article 7 of the Federal Law dated 27.07.2006 No. 152-FZ "On Personal Data", and measures to ensure the security of personal data during their processing set forth in Article 19 of the Federal Law dated 27.07.2006 No. 152-FZ "On Personal Data".
1.12. The Rights Holder has the right to perform automated processing of the information submitted by the User.
1.13. In case third parties have claims against the Rights Holder regarding the use of data (including personal data of third parties) posted by the User, the User undertakes to settle such claims independently and at their own expense, as well as to compensate the Rights Holder for all costs and losses incurred as a result of the violation of this clause committed by the User.
1.14. In accordance with the Federal Law of July 21, 2014 № 242-FZ all personal data of Users are stored on the server located on the territory of the Russian Federation at the address: Leningrad region, Dubrovka settlement, Sovetskaya street, 1.
1.2. By registering on the Service, the User gives the Rightholder his/her unconditional consent to the processing of his/her personal information, both uploaded by the User and received by the Rightholder in the course of fulfillment of his/her obligations under the Agreement.

2.1. Processing of personal information is based on:
- on the principles of legality and fairness;
- on processing only such information that meets the purposes of its processing;
- on compliance of the content and scope of the processed information with the stated processing purposes.
2.2. Processing of personal information is carried out to fulfill the obligations under the Agreement, i.e. to ensure the full functioning and compliance of the Service with the purposes stated in the preamble of the Agreement, namely the management of the estimated document flow.
2.3. The Licensor does not directly collect, store, process Users' payment instruments when making payments on the Service.
2.4. Processing of the User's information is carried out for the purposes of:
2.4.1. creation of the User's personal account;
2.4.2. authorization of the User;
2.4.3. recovery and change of the password for access to the User's personal account;
2.4.4. sending the User information necessary for performance of obligations under the Agreement, including sending newsletters.
2.4.5. sending the User other information necessary for the use of the Service.
2.5. The Rightholder also has the right to use the User's personal information for purposes that do not contradict the current legislation of the Russian Federation.
2.6. The personal information processed must not be redundant in relation to the stated purposes of its processing.
- on the principles of legality and fairness;

- on compliance of the content and scope of the processed information with the stated processing purposes.
2.2. Processing of personal information is carried out to fulfill the obligations under the Agreement, i.e. to ensure the full functioning and compliance of the Service with the purposes stated in the preamble of the Agreement, namely the management of the estimated document flow.
2.3. The Licensor does not directly collect, store, process Users' payment instruments when making payments on the Service.
2.4. Processing of the User's information is carried out for the purposes of:
2.4.1. creation of the User's personal account;
2.4.2. authorization of the User;
2.4.3. recovery and change of the password for access to the User's personal account;
2.4.4. sending the User information necessary for performance of obligations under the Agreement, including sending newsletters.
2.4.5. sending the User other information necessary for the use of the Service.
2.5. The Rightholder also has the right to use the User's personal information for purposes that do not contradict the current legislation of the Russian Federation.
2.6. The personal information processed must not be redundant in relation to the stated purposes of its processing.
3.1. When you add information to your account, when you register for the Service, or while using the Service, such information is not made publicly available. The User's comments, as well as other information left by the User on the pages of the Service in the course of its use, will be available for viewing only to the circle of persons selected by the User.
3.2. The Rightholder shall transfer the User's personal information in cases expressly provided for by the legislation of the Russian Federation and international agreements.
3.3. Provision of personal information of Users at the request of state bodies (local authorities) shall be carried out in accordance with the procedure provided for by the legislation of the Russian Federation.
3.4. The information posted by the User on the Service (text messages of the User, images, and other electronic messages) is stored during the entire period of use of the Service, and in case of deletion of the User's personal account - 6 (six) months from the date of deletion. At the request of the User, sent by e-mail to the Administrator by the Rightholder, personal information about the User is to be removed from the pages of the Service within 10 (ten) working days, and stored on the server of the Rightholder, such information will also be for 6 (six) months from the date of receipt of the relevant application by the Administrator.
3.5. Information and/or materials left by the User on the pages of the Service are subject to immediate and irrevocable removal from the pages of the Service in cases when such materials and/or information:
3.5.1. contain calls for mass disorder, extremist activity, participation in mass (public) events held in violation of the established order;
3.5.2. are left for the purpose of committing criminally punishable acts, for disclosure of information constituting a state or other secret specially protected by law, for dissemination of materials containing public calls for terrorist activity or publicly justifying terrorism, other extremist materials, as well as materials promoting pornography, the cult of violence and cruelty, and materials containing profanity;
3.5.3. are inaccurate, contradicting publicly available information;
3.5.4. contain information about the private life of a citizen in violation of civil legislation;
3.5.5. contradict the requirements stipulated by the legislation of the Russian Federation on referendums and the legislation of the Russian Federation on elections;
3.5.6. violate the rights and legitimate interests of citizens and organizations, including the honor, dignity and business reputation of citizens and the business reputation of organizations;
3.5.7. are disseminated for the purpose of concealing or falsifying socially significant information or disseminating knowingly inaccurate information under the guise of reliable reports;
3.5.8. are disseminated for the purpose of defaming a citizen or certain categories of citizens on the grounds of sex, age, race or ethnicity, language, attitude to religion, profession, place of residence;
3.5.9. contain pornography, including pornographic images and/or announcements about the involvement of minors as performers for participation in entertainment events of pornographic nature;
3.5.10. contain information about ways, methods of development, manufacture and use of narcotic drugs, psychotropic substances and their precursors, places of purchase of such drugs, substances and their precursors, as well as about ways and places of cultivation of drug-containing plants;
3.5.11. contain information about ways of co-cultivation of drug-containing plants.
3.6. The Administrator also has the right to block the User's personal account without explanation in case the latter violates any of the terms of the Agreement and/or "Privacy Policy".
3.2. The Rightholder shall transfer the User's personal information in cases expressly provided for by the legislation of the Russian Federation and international agreements.
3.3. Provision of personal information of Users at the request of state bodies (local authorities) shall be carried out in accordance with the procedure provided for by the legislation of the Russian Federation.
3.4. The information posted by the User on the Service (text messages of the User, images, and other electronic messages) is stored during the entire period of use of the Service, and in case of deletion of the User's personal account - 6 (six) months from the date of deletion. At the request of the User, sent by e-mail to the Administrator by the Rightholder, personal information about the User is to be removed from the pages of the Service within 10 (ten) working days, and stored on the server of the Rightholder, such information will also be for 6 (six) months from the date of receipt of the relevant application by the Administrator.
3.5. Information and/or materials left by the User on the pages of the Service are subject to immediate and irrevocable removal from the pages of the Service in cases when such materials and/or information:
3.5.1. contain calls for mass disorder, extremist activity, participation in mass (public) events held in violation of the established order;
3.5.2. are left for the purpose of committing criminally punishable acts, for disclosure of information constituting a state or other secret specially protected by law, for dissemination of materials containing public calls for terrorist activity or publicly justifying terrorism, other extremist materials, as well as materials promoting pornography, the cult of violence and cruelty, and materials containing profanity;
3.5.3. are inaccurate, contradicting publicly available information;
3.5.4. contain information about the private life of a citizen in violation of civil legislation;
3.5.5. contradict the requirements stipulated by the legislation of the Russian Federation on referendums and the legislation of the Russian Federation on elections;
3.5.6. violate the rights and legitimate interests of citizens and organizations, including the honor, dignity and business reputation of citizens and the business reputation of organizations;
3.5.7. are disseminated for the purpose of concealing or falsifying socially significant information or disseminating knowingly inaccurate information under the guise of reliable reports;
3.5.8. are disseminated for the purpose of defaming a citizen or certain categories of citizens on the grounds of sex, age, race or ethnicity, language, attitude to religion, profession, place of residence;
3.5.9. contain pornography, including pornographic images and/or announcements about the involvement of minors as performers for participation in entertainment events of pornographic nature;
3.5.10. contain information about ways, methods of development, manufacture and use of narcotic drugs, psychotropic substances and their precursors, places of purchase of such drugs, substances and their precursors, as well as about ways and places of cultivation of drug-containing plants;
3.5.11. contain information about ways of co-cultivation of drug-containing plants.
3.6. The Administrator also has the right to block the User's personal account without explanation in case the latter violates any of the terms of the Agreement and/or "Privacy Policy".
4.1. Cookie - files that the Service records in the memory of the User's device, with the help of which he visits the Service. Cookies are stored in the file directory of your browser (application software for browsing the pages of the Service). On the next visit to the Service, the User's browser considers the contents of the cookies and will transmit the data to the Service or the element that recorded them.
4.2. By accepting the Agreement and the "Privacy Policy", the User gives his/her unconditional consent to the Contractor for the use of cookies. The User's visit to the pages of the Service using a browser that accepts cookies is also regarded as an expression of the User's consent to the fact that the Contractor may use cookies.
4.3. The main purpose of using cookies is to make the Service more convenient for the User. In order for the User to use the Service without delays, the Executor at repeated (and each subsequent) use of the Service uses the data of the User's browser about the results of authentication when entering the protected sections of the Service, information about the visited pages of the Service, preferences and settings of the User and other similar information. The Contractor does not collect, store, process and transfer to third parties the User's cookies, it only uses them for the above-mentioned purposes.
4.4. The Contractor collects and systematizes user cookies to identify a particular User.
4.5. The User realizes that cookies may be transferred to third parties when using the Service, however, the Contractor does not initiate such transfer.
4.6. The sokie files can be deleted by the User at any time using the browser settings. The User also has the option to disable cookies, which may adversely affect some services of the Service and may not allow you to fully utilize all features of the Service. Different browsers use different ways to disable cookies, but the options are usually found in the Tools or Settings menu. Detailed information on how to disable cookies can be found in the help system of the browser used by the User. In addition to controlling cookies, browsers usually provide tools to control other similar cookies, such as local shared objects. One such means is a privacy regime.
4.2. By accepting the Agreement and the "Privacy Policy", the User gives his/her unconditional consent to the Contractor for the use of cookies. The User's visit to the pages of the Service using a browser that accepts cookies is also regarded as an expression of the User's consent to the fact that the Contractor may use cookies.

5.1. Правообладатель принимает технические и организационно-правовые меры в целях обеспечения защиты персональной информации Пользователя от неправомерного или случайного доступа к ним, уничтожения, изменения, блокирования, копирования, распространения, а также от иных неправомерных действий.
5.2. В целях обеспечения безопасности персональной информации Правообладателем проводятся следующие мероприятия:
- определяются угрозы безопасности персональной информации при ее обработке на Сервисе;
- применяются организационные и технические меры по обеспечению безопасности персональной информации при их обработке на Сервисе;
- применяются средства защиты информации, прошедшие в установленном порядке процедуру оценки соответствия;
- проводится оценка эффективности принимаемых мер по обеспечению безопасности персональной информации;
- принимаются процедуры, направленные на выявление фактов несанкционированного доступа к персональной информации;
- производится восстановление персональной информации, модифицированной или уничтоженной вследствие несанкционированного доступа к ней;
- устанавливаются правила доступа к персональной информации, обрабатываемой на Сервисе, а также обеспечивается регистрация и учет всех действий, совершаемых с персональной информацией на Сервисе;
- осуществляется постоянный контроль над принимаемыми мерами по обеспечению безопасности персональной информации.
Правообладатель не несет ответственности за действия третьих лиц, получивших доступ к персональной информации Пользователя в результате несанкционированного доступа к Сервису, а вследствие также иных противоправных действий, совершенных третьими лицами, когда Правообладатель не мог их предвидеть либо воспрепятствовать им.
5.2. В целях обеспечения безопасности персональной информации Правообладателем проводятся следующие мероприятия:
- определяются угрозы безопасности персональной информации при ее обработке на Сервисе;
- применяются организационные и технические меры по обеспечению безопасности персональной информации при их обработке на Сервисе;
- применяются средства защиты информации, прошедшие в установленном порядке процедуру оценки соответствия;
- проводится оценка эффективности принимаемых мер по обеспечению безопасности персональной информации;
- принимаются процедуры, направленные на выявление фактов несанкционированного доступа к персональной информации;
- производится восстановление персональной информации, модифицированной или уничтоженной вследствие несанкционированного доступа к ней;
- устанавливаются правила доступа к персональной информации, обрабатываемой на Сервисе, а также обеспечивается регистрация и учет всех действий, совершаемых с персональной информацией на Сервисе;
- осуществляется постоянный контроль над принимаемыми мерами по обеспечению безопасности персональной информации.
Правообладатель не несет ответственности за действия третьих лиц, получивших доступ к персональной информации Пользователя в результате несанкционированного доступа к Сервису, а вследствие также иных противоправных действий, совершенных третьими лицами, когда Правообладатель не мог их предвидеть либо воспрепятствовать им.

6.4. "Privacy Policy" is an integral part of the Agreement published on the pages of the Service, if the User does not agree with the provisions of this document, he undertakes to immediately stop using the Service.
6.5. The law of the Russian Federation shall apply to the relations between the User and the Rights Holder arising in connection with the use of the User's personal data. Acceptance of the Agreement and "Privacy Policy" as an integral part of it by a foreign User means that the text of these documents is clear to him and does not need translation. In case of need for translation, foreign Users undertake to make such translation into the required language by their own efforts and at their own expense. In case of discrepancies between the Russian and foreign versions of the Agreement, the Russian version shall prevail.
6.2. The Rightholder has the right to unilaterally change the text of this document without prior notice to the User. The responsibility for timely familiarization with the current version of the "Privacy Policy" lies entirely on the User.
6.3. All disagreements and disputes arising in connection with the use of the User's personal information shall be resolved in the manner prescribed by the Agreement.
6.4. "Privacy Policy" is an integral part of the Agreement published on the pages of the Service, if the User does not agree with the provisions of this document, he undertakes to immediately stop using the Service.
6.5. The law of the Russian Federation shall apply to the relations between the User and the Rights Holder arising in connection with the use of the User's personal data. Acceptance of the Agreement and "Privacy Policy" as an integral part of it by a foreign User means that the text of these documents is clear to him and does not need translation. In case of need for translation, foreign Users undertake to make such translation into the required language by their own efforts and at their own expense. In case of discrepancies between the Russian and foreign versions of the Agreement, the Russian version shall prevail.
